What Panama actually requires

Panama belongs to the Hague Apostille Convention, but Nigeria does not. This means a Nigerian document cannot receive a Nigerian apostille. It must instead follow the authentication and embassy-legalization process required by the Panamanian authority that will receive it.

Start with the correct Nigerian document. An original civil record, such as an NPC birth certificate or federal marriage certificate, does not normally need notarization simply because it will be used abroad. An affidavit, power of attorney, certified copy or other private document may need notarization before Nigerian Ministry of Foreign Affairs authentication. Confirm the requirement for the particular document.

After completing any required verification or notarization, have the document authenticated by the Nigerian Ministry of Foreign Affairs. Ask the Panamanian institution or authority receiving the document whether this authentication is sufficient or whether embassy legalization is also required.

Panama does not appear to have a resident embassy in Nigeria. In a recent Antarch Consulting case, the client was advised to legalize the documents through the Embassy of Panama in Rabat, the capital of Morocco, after completing Nigerian Ministry of Foreign Affairs authentication. Before sending any original document to Morocco, confirm with the receiving authority in Panama that this embassy step is required and obtain the embassy’s current submission, fee and return-delivery instructions.

Some Panamanian authorities may require an additional confirmation by Panama’s Ministry of Foreign Affairs after the documents arrive in Panama. Ask the institution or authority receiving the documents whether this extra step applies to your situation.

Translation. Spanish translation is commonly required for Nigerian documents used in Panama. Ask the authority receiving the documents in Panama whether it requires a translation by an authorized translator. Also confirm whether the document and its authentication or legalization stamps must be translated, and at what stage the translation should be completed.

Which Nigerian documents this affects

Common records include an NPC birth certificate, a federal marriage certificate, single-status or no-impediment evidence, and a divorce or death certificate. Other examples include a Police Character Certificate, WAEC certificate, degree, transcript, professional licence, power of attorney, affidavit, adoption or court order, and commercial records.

Timelines and planning

If legalization by the Embassy of Panama in Morocco is required, this will probably be the slowest stage because the original documents may need to be sent across borders and returned securely. Allow time for preparation in Nigeria, Ministry of Foreign Affairs authentication, embassy processing, return delivery, any further confirmation required in Panama and Spanish translation. Police, medical and single-status records may have validity limits, so confirm the acceptable issue dates before obtaining them.

Common Legalization Mistakes to Avoid

• Requesting a Nigerian apostille. Nigeria is not a party to the Apostille Convention.
• Notarizing every document after Ministry of Foreign Affairs authentication. Notarization is not required for every public document and, where it is required, it is normally completed before Ministry of Foreign Affairs authentication. Confirm the correct order for your document before paying.
• Sending original documents to Morocco before the Embassy of Panama confirms that it will accept them and provides current submission and return instructions.
• Stopping after embassy legalization without checking whether the receiving authority also requires further confirmation in Panama or an authorized Spanish translation.
• Treating legalization as proof that the school, court, registry, employer, migration office or professional regulator must accept the document for its intended purpose.
